Terms of Service

These Terms govern your use of DeliverAI at deliverai.co.za. By using our platform you agree to these Terms. Please read them carefully before booking a delivery or creating an account.


1. Acceptance of Terms

By accessing or using DeliverAI — whether through our website, any mobile-optimised version, or related services — you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and accept these Terms of Service in full.

If you are using DeliverAI on behalf of a business, you represent that you have authority to bind that entity to these Terms, and references to "you" include that entity.

We may update these Terms from time to time. Continued use of the platform after changes are published constitutes acceptance of the revised Terms.


2. Service Description

DeliverAI is a delivery price comparison and booking platform operating in South Africa. We aggregate real-time pricing from third-party delivery providers — including Uber Connect, Bolt Send, The Courier Guy, DSV, and Pargo — and allow you to compare quotes and book a delivery in one place.

DeliverAI does not employ drivers, own vehicles, or operate any delivery service. Once you book, the delivery is fulfilled entirely by the selected third-party provider, subject to their own terms and conditions.

Comparing quotes and booking through DeliverAI is currently free of charge. You pay the delivery provider's published rate with no markup or service fee. DeliverAI funds operations through Pro features, partnership revenue-share, and optional premium services. We will give reasonable notice on this page before any fees are introduced.


3. User Obligations

When using DeliverAI you agree to:

  • Provide accurate, complete, and up-to-date information when creating an account or placing a booking (name, contact details, delivery addresses, parcel dimensions and weight).
  • Not use the platform for any unlawful purpose or in violation of any applicable South African law or regulation.
  • Not send prohibited, illegal, dangerous, or restricted items through any provider booked via our platform.
  • Not attempt to circumvent, disable, or interfere with the security or functionality of the platform.
  • Keep your account credentials confidential and notify us immediately at hello@deliverai.co.za if you suspect unauthorised access.
  • Not resell or commercialise access to DeliverAI's comparison data or booking infrastructure without our prior written consent.

You are solely responsible for the accuracy of parcel details you provide. Inaccurate dimensions or weights may result in additional charges from the delivery provider, for which DeliverAI accepts no liability.


4. Booking & Payments

All payments are processed in South African Rand (ZAR) via Yoco, our payment service provider. By completing a booking you authorise DeliverAI to charge your selected payment method for the quoted amount shown at checkout. No additional platform markup is added on top of the displayed courier rate.

Quotes displayed on the platform are estimates sourced from third-party providers and are subject to change. The final amount charged is the price confirmed at checkout.

Refunds & cancellations: Once a booking is confirmed and the delivery provider has accepted the job, cancellations and refunds are subject to the relevant provider's policy and South African consumer protection law. DeliverAI does not charge a separate non-refundable platform fee on bookings.

If a payment fails or is disputed, DeliverAI reserves the right to suspend your account pending resolution.


5. Limitation of Liability

DeliverAI provides the platform on an "as is" and "as available" basis. To the maximum extent permitted by South African law, we exclude all warranties, express or implied, including fitness for a particular purpose and uninterrupted availability.

Because DeliverAI does not perform deliveries, we are not liable for:

  • Loss, damage, or theft of parcels during transit.
  • Delays or failed deliveries caused by third-party providers.
  • Inaccuracies in provider pricing data beyond our reasonable control.
  • Any indirect, special, or consequential losses arising from your use of our platform.

Our aggregate liability for any claim arising from your use of DeliverAI is limited to the greater of (a) the amount you paid DeliverAI in respect of the booking giving rise to the claim, or (b) ZAR 500. Where DeliverAI charges no service fee on a booking, (b) applies.

Nothing in these Terms limits liability that cannot be excluded under the Consumer Protection Act 68 of 2008 or any other mandatory South African legislation.


6. Third-Party Delivery Providers

Delivery services are provided by independent third parties (Uber Connect, Bolt Send, The Courier Guy, DSV, Pargo, and any future partners). By booking through DeliverAI, you enter into a separate service agreement with the chosen provider, governed by their terms and conditions.

We are not responsible for the acts, omissions, or service quality of any delivery provider. Any complaints relating to the delivery itself — such as damaged goods or late arrival — should be directed to the relevant provider in the first instance.

Provider pricing data is refreshed regularly, but we cannot guarantee it is current at all times. Always confirm the final price at checkout before completing your booking.


7. Intellectual Property

All content on DeliverAI — including our name, logo, design, software, comparison algorithms, and written content — is the exclusive property of DeliverAI and is protected under South African intellectual property law.

You may not copy, reproduce, distribute, or create derivative works from any part of our platform without our prior written consent. You are granted a limited, non-exclusive, revocable licence to use the platform for personal or business delivery comparison and booking purposes only.


8. Privacy & POPIA Compliance

DeliverAI collects and processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). We collect only the information necessary to provide our services — such as your name, contact details, and delivery addresses — and we do not sell your personal information to third parties.

Your personal information may be shared with the delivery provider you select solely for the purpose of fulfilling your booking. By using DeliverAI, you consent to this processing.

You have the right to access, correct, or request deletion of your personal information at any time by contacting us at hello@deliverai.co.za. For full details, please refer to our Privacy Policy.


9. Termination

You may close your DeliverAI account at any time by contacting us. Pending or in-progress bookings will be completed in accordance with the relevant provider's process.

DeliverAI reserves the right to suspend or terminate your account, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent activity, or used the platform in a manner that may harm other users or our business.

Sections relating to liability, intellectual property, and governing law survive termination of these Terms.


10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts, without prejudice to your rights as a consumer under the Consumer Protection Act.
